These Terms of Service ("Terms") govern your access to and use of Blinkly ("Service"), operated by Blinkly. By creating an account or using the Service, you agree to these Terms.

1. The Service

Blinkly helps you prepare and submit DMCA counter-notices in bulk. You are responsible for reviewing every URL and submission before it is sent. Blinkly automates form submission but does not provide legal advice.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Credits and billing

The Service uses a prepaid credit system. Credits are consumed when submissions are processed. Credit packages and pricing are shown at checkout. Purchased credits expire according to the plan you selected. Except where required by law, credit purchases are non-refundable once credits have been used.

4. Your responsibilities

You agree that:

  • Information you provide in counter-notices is accurate and submitted in good faith.
  • You have the legal right to dispute the notices you submit through Blinkly.
  • You will not use the Service for fraudulent, abusive, or unlawful purposes.
  • You comply with applicable laws, including the DMCA and its counter-notice requirements.

5. No legal advice

Blinkly is a software tool, not a law firm. Nothing in the Service constitutes legal advice. Consult qualified counsel before filing counter-notices if you are unsure of your rights or obligations.

6. Availability and changes

We may modify, suspend, or discontinue features of the Service at any time. We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the revised Terms.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that submissions will be accepted, processed on a particular timeline, or result in reinstatement of content or search rankings.

8. Limitation of liability

To the maximum extent permitted by law, Blinkly and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service.

9. Termination

We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or others. You may stop using the Service at any time.
